Pink sheet market makers can 'sell short' anything they want. If you believe that the SEC is actively enforcing its 'REGSHO' rules against, then I dont know what to tell you. SEC doesnt GAF and is totally MIA in my opinion.
Normally they wont attack these issues with super low share counts, but now and then they just cant resist the urge to manipulate an issue lower. Oh, excuse me, they cant resist the urge to 'provide liquidity.'
