They FDA rules are the same for everyone. Thousands of IND are filed and approved every year. Just because people are terminal doesn't mean the FDA is just going to rubber stamp every fly by night companies treatment nor do they just rubber stamp an approval for new drugs before review all of the trial data which takes months. Its called a process and if people don't like the process they can do trials and sell drugs in a country that doesn't have a good process.
