It was their argument that AKBA didn't have ground to stand on and requesting to have the case dismissed. The judge denied the argument given that it was still in federal court of appeals and denied the motion to have it dismissed. They did a last ditch effort to have a ruling to dismiss the case and it failed.

If it is found that their drug was wrongfully declined to be covered by Medicare that would be big.

Not just in sales and revenue increase but could be rewarded compensation if wrongfully removed from coverage.
