I do not believe Ziv Turner legally should have said that. I think that the results are supposed to be stated after the voting is completely done. I do not want to get Ziv in trouble.

It is also a mute issue now since as Howard says the preferred shares that are not converted do not have voting rights. On Aug 31,the date of the alleged comment, they were close to passing because all of DGF and Sunbeam were Yes votes to either proposition 1 or proposition 2 or both. I do not have inside knowledge of this, but suspect that is what their vote was.
