debtor's strategy- give a small candy to EC,so that the EC attorneys will not fight in court.
The $1m budget to EC is small compared with $37m re-org costs JCPenney spends every month.
Debtor now can concentrate on its planned RSA. Debtor pays a small amount to AD EC to get what debtor and creditors want at the end. What should EC do?
