I don't see why the judge would not just grant it considering the statement above. Doesn't that state Bertagnolli is in favor? What is there to argue? Why would he need representation if he doesn't want to contest?

I bet he doesn't want to pay or cannot afford representation. If my understanding is correct, I don't see what would keep this from going through on 10/7 unless Bertagnolli shows up and contests it. Which doesn't seem likely.
