Dec 9, is the end game date. If the executive branch is going to do something it will be done before then. The base issue that will effect all other issues before the court will be how and or if the severability doctrine can be applied to correct a poorly constructed statute. It is my opinion that the gov realizes that the end game is at hand. Do they want to take the risk that they have to contend with the costs of finding HERA unconstitutional? Think about what that would mean. Tens of millions of homeowners who lost their homes due to MERS foreclosure schemes. The MBS markets, bank settlement clawbacks. Contract disputes. State Pension Fund lawsuits not to mention the shareholder lawsuits from the illegal conservatorships. Timing is everything in politics. Though that outcome may have a small chance of happening, I believe the gov will settle in a way that makes all parties happy without putting up too much of a fight that means including the warrants as well. They will save face. They will do this and Trump will claim a victory over Obama for fixing the GSEs and protecting the taxpayers and providing affordable housing due to his great leadership. The news media will ignore covering this as they have the Middle East peace deals because orange man bad.
