...and it's not a "ruse" if they still need to RS to stay on NASDAQ. In this suggested scenario they are hoping to get patent approval over a specific time period. If they don't, it is business as usual, right? How is that a "ruse?" More like uncertainty and, of course, lack of transparency to shareholders.
