The patent is "valid" until a court rules it as "invalid". I suspect this is around a 50/50 proposition, which is why the judge in the interference trial chose not to rule on it. Intel gains no monetary advantage from having it in the library, so why bother? Once a notice of infringement is given, it is in Intels interest to make sure they are not violating.
