They could do either way once they keep DESTQ common shareholders to own over 50% of the Newly-merged company. If DESTQ emerges from the CH11 then DESTQ will not be a Shell company. The higher ownership by Marquee the higher valuation DESTQ will be. No idea if they will hire a New CEO after the merger or acquisition? You should be able to find out if the new hires own the stock options or not from the New company's SEC filings after the deal.
Anyway I won't sell any Single share before the POR kicks in since current price levels 0.02xx are ridiculous low comparing to its true valuation!
