Only because this company refuses to even confirm information on the patent that would not be under NDA...only specifics (like questions they are getting, communications between them and the USPTO) are under NDA. How about a communication that confirms they feel they are on track and still working towards securing it...assuming that's the case. They could couch this with all sorts of disclaimers about forward looking statements...but nonetheless would send a message that the patent is not dead
