What We Know About CBD Legislation Right Now

CBD Isolate is an absolute lock

This is the strong preference of the FDA

Congress has reflected this reality as well ever since HR 5587 was introduced in January 2020, which only legalizes CBD Isolate in Beverages/Foods and Supplements

The FDA detests THC, a fact which I’ve always highlighted:

The “different article” argument is irrelevant because of safety concerns surrounding THC

So Full Spectrum CBD (THC + CBG/CBN/CBC, etc + CBD) is something which appears highly unlikely to be legalized by Congress right now

The difference between January 2020 and now is that Broad Spectrum CBD has more of a chance in Dr. Hahn’s FDA, especially this close to the election

The FDA does not like Broad Spectrum CBD, due to the unknown safety of all the non-THC and non-CBD cannabinoids (CBG/CBN/CBC, etc) and the lack of ability to standardize a Broad Spectrum extract — every batch is always going to be different

But Dr. Hahn is now in charge and he is more pro-hemp than Dr. Gottlieb

It was very clear that Dr. Gottlieb was fixated on CBD Isolate ONLY

Dr. Hahn is more open to the possibility of Broad Spectrum as well, but the FDA brass who are in charge of developing the Enforcement Discretion Regulations would prefer CBD Isolate to be the only formulation permitted until more is known about the other cannabinoids

In terms of Beverages/Foods vs Supplements, there is a possibility that CBD Isolate is the only formulation legalized for the former, whereas CBD Isolate and Broad Spectrum may be legalized for the latter

This is because Beverages and Foods have a higher bar for safety than Supplements

Supplements: CBD Isolate is a lock, Broad Spectrum is a possibility

I expect to see new CBD Legalization legislation replacing HR 5587 in September

I believe this new legislation is the source of excitement we have seen in Jonathan Miller since April — he is dying for Congress to introduce it so he can rally around it
