As anticipated, the well-entrenched and celebrated MJ industry in California was able to defeat the new kid on the block, Hemp-CBD

From a federal perspective, it’s a complete 180 — MJ is demonized by every federal agency while Hemp is viewed as a brand new exciting industry with a ton of promise — it’s been treated with kid gloves by the FAA and USPS, and the USDA developed interim regulations in record time

The vast majority of federal agencies are on board, with the exception of the DEA and FDA

With Hemp and all of its cannabinoids (even THC as long as it’s kept below .3%) completely free from the Schedule of Controlled Substances, the only power the DEA has is to run some interference with the farming of hemp — they have been kneecapped otherwise

The FDA is now under Dr. Hahn, who was able to deliver a formal policy of Enforcement Discretion for CBD Products to The White House (OMB) in less than 8 months on the job — so this isn’t your typical FDA, especially under the pressures that come with 2020 being an election year

We have 2 different legislative opportunities in September to pass the kind of CBD Legalization bill that Jonathan Miller has been hinting at since April 2020 — the Phase Four Covid-19 Economic Stimulus Bill is one we’ve covered greatly for awhile now

The 2nd legislative opportunity is the must-pass federal funding omnibus bill, which will need to run thru Congress by the end of September, when funding for the feds will expire

A CR, or Continuing Resolution, is expected to be the form of funding legislation in 2020, and all kinds of unrelated bills will be attached to it

So with this pair of possibilities, there are absolutely no excuses for Mitch in September 2020

He is very careful not to directly implicate the MJ industry — that’s a politically wise thing to do in a state like CA
