Is it HERA or the SPSA or both that caps the GSES' size of their mortgage portfolio?

My thinking here is, maybe MC is thinking about letting them grow the Mortgage Portfolio (this would entice new equity investors) and as regulator he could "sleep well at night", knowing that two monoline insurance companies have plenty of capital as determined by Basel III and it's commensurate International Commercial Bank capital ratios?
