Unfortunately this is not true. Companies pay fines to settle or make plea deals all the time. They do this to save time and large attorney expenses. Fines are sometimes just that, it means zero in a separate trial. Jimmy is not dumb, crook maybe, but not dumb. He would bankrupt you on motions, the SEC will not fight for you, they only look at criminal violations and act accordingly. Your civil suit would be a separate issue. Unless you have oh say 35,000 throw down for a retainer fee, I would say he wins. Not being an A$$ just stating the obvious.
