Let me get this straight. You think Simon is bidding to buy JCP outright plus buying worthless shares of common stock in the open market the gain a majority and take over the company. They could literally do that all at once if that was their intention. They'd have no reason to buy shares in the open market for months. Matter of fact they could buy JCP issue their execs shares and then buy back shares to increase the value. Which would be smarter than wasting money on common shares in the open market.
