Based on what I’ve read so far, the difference between the House Bill and the Senate “Bill” is that the House threw every single piece of legislation they wanted to pass into the 1st published version of their economic stimulus bill (HEROES Act), which really wound up being a very finished piece of legislation, whereas the Senate “Bill” (HEALS Act) much more closely resembles an extremely stripped down first draft proposal that hasn’t yet coalesced into anything near its final form

There isn’t even a single bill from the Senate yet — instead there are a series of unfinished proposals from the various Committee Chairs

I’m in the midst of reading through the variety of proposals right now and so far, I’m not seeing any mention of CBD-related legislation, though I still have some reading to do

If there isn’t anything CBD-related in this first sketch, that doesn’t mean Mitch won’t insert CBD legislation into the bill as it moves forward

This is a very bare bones structure to start and I anticipate many legislative additions to it as it moves through the Senate

The timing of the FDA sending its CBD Enforcement Discretion Policy to the White House late last week was a very pleasant surprise, and a very encouraging sign that things are going to open up nationally for the CBD industry this summer

Enforcement Discretion for CBD is essentially de facto CBD Legalization, as it would result in truly national sales, along with many other things that would accompany legalization (banking, investment, infrastructure, distribution, etc)

I wrote a more comprehensive piece in November 2019 on what Enforcement Discretion actually entails and why it is considered “legalization” in many circles

I’m thrilled that it appears we are going to get Enforcement Discretion for CBD Products this summer

But I really want CBD Legalization as well, as that would really maximize investor interest

And we may very well get it later this week or next week

Let’s see what Jonathan Miller has to say next — he’s been pushing the prospects of Pure CBD Legalization in this economic stimulus bill pretty hard and has more of an inside scoop than just about anybody else out there

We are just getting started

Stay tuned...
