SCOTUS is wrong. The FHFA didn't surge in 2008 for the first time, but it simply succeeded the previous Federal Agency OFHEO, established in 1992.
The 1968 Privatization of FNMA Act calls fnma "Government-Sponsored Private Corporation". That is, a private corporation with a Treasury backstop in the Charter.
The FHFA is and will always be a Federal Agency. Other thing is that, as Conservator, it has other powers.
