Federal judges do not like to be overturned on appeal. Maybe the judge anticipated all along that the Bolzans would try to hatch the No Speak English defense. Therefore, he told the clerk and BSF to serve local counsel also knowing that STUPID is not a defense. Therefore, if the Bolzans used local Brazilian counsel who was not bilingual and who couldn't speak English, the Bolzans could not say that we don't speak English. STUPID is not a defense and they would be stupid and would ask the court to use stupid as an affirmative defense when it was not pled in the answer that local counsel speaks no English and put the documents on his desk and didn't have them translated. It is a STUPID conclusion which I don't believe the judge will come to. Daniela Bolzan speaks fine English
