Then he as plenty of time to wave it. Smart lawyers don't just cave, even against the most overwhelming odds. It's a chess match to eventually make a deal Mark Schena can except. The hearing will likely be waved when it gets close. Unless Mark Schena is a real solid bonehead and wants to fight this to the end... That will get him 20 years in a Federal pen.
