If the 101 and other issues are ruled on in WDDDs favor I believe ATVI will make a lowball offer to WDDD. Since none of us are privy to what is going on behind the scenes it is all just speculation. In my opinion, I don't think WDDD would accept a lowball offer. As far as good faith settlement negotiations I don't think ATVI is really looking to settle at this point. A trial is still approximately 1 year away. Once a trial date is set, then any offers become more serious (higher offers), which will increase in price the closer it gets to the trial date.
