The more I think about this I am wondering if Momenta is going to claim their patent should not be valid at all for manufacturing. ie "they did not adequately describe the manufacturing process" and the patent should never have been approved.
Copaxone would have had to go off patent for us to get FDA approval to produce a generic.
Therefore, if their patent wasn't proper in the first place and never should have been approved, could they argue Teva should not be able to manufacture Copaxone at all since they may never haver had a valid patent. I know that is wild but they had to be off patent for us to get a generic approval.
Just saying, if they never fully described the manufacturing process are the now stopped from producing the drug. If that happens, it is rocket time for Momenta. Otherwise why go to all this trouble if they were not going to shut Teva down on selling Copaxone? Just thinking out loud here.
