They made extra effort to reassure investors that they will use this option when it’s sure thing.

“CVSI has no intention of using the discretion granted to it by the stockholders in Proposal 2 to effectuate a reverse split of its common stock unless required to do so in order to have its common stock listed on the Nasdaq Capital Market or another major national exchange.”
