What patent rights? This is old tech from the early 90's.

"Dim signed agreement with TMMI to include(bonus) the fractal code tmmi had sued for."

What a deal, the Dentist offered TMMI and agreement to use code it already licensed from Iterated in the 1990's? What's going on here?

At this point TMMI should really think about suing for significant damages it has suffered for all these years.
