Interesting. It's not inaccurate language if the SEC says something that is misleading, e.g "up to," (we know it is misleading because it cannot stand on it's own prima facie meaning) but if Berman "forecasts" a number it is automatically misleading. How did the SEC confirm whether or not Berman had access to or reason to believe he had access to that kind of production?
