TenKay, you seem to over-focus on the SEC law enforcement role, but as a regulatory agency they only have 'administrative powers' and they are much more responsible for creating and maintaining a Market Place than punishing abusers (that's a very small part of their mission)...

In an 'emergency suspension' review, after-the-fact, nothing stops the SEC from seeking to remedy a mistake, on their own volition, even without the injured initiating action, and reaching out to OTC Markets and FINRA to remedy a mistake... their rules permit this... After all, the SEC mission is three-part:

"to protect investors; maintain fair, orderly, and efficient markets; and facilitate capital formation."

You can say that the SEC has a duty to rectify it's errors, if the errors harm stock holders, interferes in orderly markets and interferes with capital formation...


The SEC does not care about BVTK's reverse split.

Assuming BVTK has the goods and nothing to hide...

The Caveat Emptor designation is typically not removed within the first 30 days. During the time it is labeled Caveat Emptor, any stock that is not in Pink Current Information will also have its quotes blocked on www.otcmarkets.com.
