Why Hemp Banking and CBD Legalization Will Pass In Economic Stimulus Bill

It’s much easier to pass legislation when it’s attached to a much larger must-pass piece of legislation like the Phase Four Covid-19 Economic Stimulus/Infrastructure Bill, as opposed to passing as standalone legislation

Because doing so usually doesn’t require Committee votes or Floor votes

The heads of the political parties typically act as the dominant deciders in this scenario

There are 4 people in Congress who will essentially determine what legislation will be permitted entrance into the Phase Four Covid-19 Stimulus/Infrastructure Bill

The Senate Majority Leader, Senate Minority Leader, Speaker of the House and House Minority Leader

Mitch, Chuck, Nancy and Kevin

We already know that Mitch and Chuck love the hemp industry and will do whatever they can to open it up in 2020

Kevin is a loyal Republican and would be expected to fall in line behind Mitch concerning issues related to Mitch’s re-election baby (Hemp), unless he feels very strongly about a particular topic

Nancy is a liberal democrat from California and pro-cannabis, though much more interested in MJ-related issues


Hemp Banking

Mitch and Chuck are a definite Yes

Kevin voted for the House version of The SAFE Banking Act, even though he isn’t very MJ-friendly, so he’s a definite Yes

If Mitch and Kevin play hardball with MJ Banking, and only want to open up Hemp Banking, then Nancy could be a “No” if MJ Banking isn’t included

Nancy will likely get some, but not all, MJ-related banking issues addressed in this legislation

Mitch — Yes
Chuck — Yes
Kevin — Yes
Nancy — Yes

Hemp Banking will PASS

*** For the record, I believe there will be several elements of MJ Banking that are included in this bill, but I don’t expect it to closely resemble the House SAFE Banking Act that passed in September 2019


CBD Legalization in Foods, Beverages and Supplements

Unlike banking, there is zero possibility of both MJ-derived CBD products and Hemp-derived CBD products being legalized, so Nancy isn’t torn here like she is with Banking

And legalizing Hemp-derived CBD products is the first legislative step towards legalizing MJ, so she’s very much on board here

Mitch — Yes
Chuck — Yes
Kevin — Yes (doubtful he feels strongly enough to vote against Mitch)
Nancy — Yes

CBD Legalization will PASS


Enforcement Discretion Policy (mandate FDA to declare it for CBD

Mitch — Yes
Chuck — Yes
Kevin — Yes
Nancy — Yes

Enforcement Discretion will PASS


USDA Reg Improvements

Mitch — Yes
Chuck — Yes
Kevin — Yes
Nancy — Yes

USDA Regs will PASS

There simply shouldn’t be very much political opposition to these Hemp & CBD bills passing

So the only question remaining concerns the level of interest in opening up the Hemp & CBD industry

If there isn’t enough interest, even though these issues are very politically viable, they could still fall by the wayside

Because both Mitch and Chuck are such strong advocates of the Hemp industry, the interest in the Senate is very high, as directly attested to by Dr. Gottlieb in Breadcrumb #1:

Nancy is very pro-cannabis and fully legalizing and opening up the Hemp industry will be a big positive step towards doing so for the MJ industry in the future, so she is pretty interested as well

Kevin is a faithful member of the Republican Party and is therefore interested purely due to making sure that Mitch gets re-elected
