Actually, if you read the FDA notice carefully what it says amounts to:
"This problem is urgent. So if your test works properly is validated and you have all your ducks in a row, we don't intend coming after you for tardy submissions, not dotting the i's or crossing the t's or the like, so go right ahead. In fact, if you want a get out of jail, send us the data and we'll even issue you a EUA if you're on the level, your test works and so long as you aren't making any claims that you can't actually substantiate.
"Of course, if your test isn't up to scratch and you push it out with made up or exaggerated claims and false advertising, then we'll be all over you like a cheap suit and down on you like a ton of bricks! Because that's our job!"

If DECN had something that worked well enough, you would be able to buy it already. But they haven't. And you can't.
