Maybe this will help. The Supreme Court is often referred to as the arbiter of final recourse. As such, in matters of extreme finality, they will issue an order which is tantamount to legislation from the bench. They really hate to so this as it harkens back to the Earl Warren days where claims of overstepping reigned rampant.

An opinion tends to be more focused on a "fix" to a constitutional dilemma that makes a recommended repair to existing legislation.

There have been entire books written on this issue, but this is the simple version and the best I can offer. I, too, would welcome input from Obi on this.
