But all of that assumes (Begs the question, a logical fallacy) BVTK cannot do anything with the patent. In all reality, they may be able to sue Microsoft, among other courses of action.

A whole lot of these tech companies do that - dangle a patent for years, wait for infringement to occur, and then tidy up the process and get an award. From there, it moves onto 'latches'.
