One thing that occurs to me is if they really think they could lose billions then why not just buy the IP? Make an offer of $2/share for any shares that they can buy. While I know a lot of people here say that's insane and nobody would take that number I think you would find that many would. Companies like Activision have teams of lawyers who look at M+A every day and I am sure they have looked at acquiring the company for their IP. Keep in mind you dont need 100% of the shares to vote yes on a buy out and at the end of the day money talks. Maybe the guy running the company has a number that he would take and walk away. ATVI has $6b in cash. Let say $5/share and they own it all?
