I understand what you are saying. However, a settlement is a compromise. If it is not a fair calculation then WDDD wouldn't settle. That is how it is done. You don't get everything you would get in a trial win. Look at VRNG. Everything was going their way. They won the trial. Some unusual turn of events and they lost everything. No guarantees in a trial. Ultimately, this is about money. ATVI offers less because they want to save $$ for their company. WDDD may be willing to take less for a variety of reasons. A guaranteed win, the end of costly litigation, possible dilution to fund the company another year or two to see the litigation through. The real cost of waiting to get $$ from a trial and then appeals that follow. The state of the economy is also a factor. The diminished value of the $$ 2 years from now vs todays dollars. These are factors WDDD will consider when negotiating a settlement. Remember both parties get injured in a fight. A Court battle is a fight. It is usually in everyone's best interest to settle. You know what you are getting and they know what they are paying.
