I'm not in favor of a settlement unless it's well above what we would get with an outright win. Since this settlement will be the yard stick by witch all other settlements will be judged, it must be at least half way between a full win & a Treble win. If it appears comfortable to an infringer to settle at the last minute than we will go to the very end with every infringer. It must be clearly shown this is the painfully wrong thing to do with WDDD. If you expect a fair settlement with WDDD caugh up the money and settle fast at a fair number considering your theft or pay dearly for your error in judgement. 9 YEARS, it's time to pay up big time. I vote to take it to the jury. Nail their head on the wall and the rest will pay up fast.
Settle cheap and you'll be begging for some cash at every negotiation.
