ENDV lost period. How bad is to be seen.

They cannot sue KVP that is granted with prejudice. KVP's counterclaims are dismissed but they can refile the lawsuit or go to the US Patent office to challenge ENDV's patents.

What is left is to construct the settlement agreement and what else will be in it. I suspect that KVP will want to get its attorney's fee paid for by ENDV and may file soon as did BIEL. They have a limited window and BIEL missed it but KVP seems to have more competent counsel.

KVP wants to extend the covenant to not sue to include any future iterations and applications of the tech, which if they get will be open season to infringe.

ENDV was desperate to dismiss the lawsuit because a summary judgement against them could be used by everyone else they are trying to sue for infringement.
