Yes, There are many possibilities.

SCOTUS should have heard both CFPB and FHFA cases together to make it quicker.

Almost every one has criticized total lawlessness of Conservatorship for the last 11 years. Even the current FHFA Director has criticized the interpretation of HERA by previous FHFA/UST officials.

But judiciary has hardly done anything but support lawlessness of conservatorship and play usual politics with interpretation of HERA.
