You ignored the capitalization:
"That is NOT Forward Looking Statement terminology."

There's a very specific LAW that deals with the protection from legal action afforded forward looking language given certain conditions (feel free to look it up or ask for help). I'll offer a simple example for you:
A CEO can use the word "expects" in a public statement with impunity if the conditions of the law are met. (See the IPIX website for examples of words that can be protected.)

A CEO CANNOT use the word "will" and expect the same protection.



ps. There is a second, separate issue that you might consider here. Is today's emailed notice a public statement? If not, does it include information that would require a public statement?
