if we don't close soon, that means we are fighting for the bank's RECOVERIES

UWB was suing for the recoveries from the RMB's before it was seized! What makes you think that Gut was willing to just give them up!!!! That would be a breach of fiduciary duty. And NO he didn't give them up in any agreement, that would have been STUPID.

And IF,like you say we are going after the recoveries---I would guess we would have to wait till all of the recoveries are in place.
