Oh I'm not talking about what the parameters of a dietary supplement definition will ultimately be. I'm talking about legality. You keep saying that hemp derived THC is federally illegal, but it was most definitely federally legalized just as much as all the other hemp derived cannabinoids. It was the only one explicitly legalized actually.

As you said, the Farm Bill designates the FDA as the agency to regulate HEMP...not CBD.

As a matter of fact, neither CBD nor Cannabidiol are mentioned even one time in the entire Farm Bill.

So...if the FDA decides to just regulate CBD, they would be neglecting quite a large portion of their assignment.
