1) A company being sued cannot acquire the suing co as it perverts justice. Bungie's attempt has already highlighted ATVI's dirty pool tactics and any Justice would be looking for any connection to the Defendant by any entity looking to takeover WDDD.
2) Insiders own over 50% of the company which already prevents a hostile takeover. All attempts will be thwarted based on a majority is already held. Unlike very large companies, where it is rare to have such high ownership, a hostile takeover can happen. Here, it was a deliberate action to prevent any such attempt by keeping over 50% ownership in tight hands.
