Yes, although it’s a logical explanation, I would never believe that the custodians wouldn’t know about this. Also the fact that they are asking for “dismissal of action” meaning they want to do nothing more with EMBR. That being said you would think they aren’t gonna lose the money that they put.... All IMO.
