Here is my theory and explanation. Kenneth Brimmer submitted a new change of registered agent with the Minnesota Secretary of State on 12/17. On the form, it includes his address, phone, and email address which is required to be served. The rightful CEO Peng set the trap on 12/6 and it appears Brimmer fell for it.
With Brimmer as the registered agent now, he can be formally served with the lawsuit. It appears this will have to go-to court to resolve this control dispute. Based on the past Minnesota court cases involving the defendant, the court works quickly and appears to resolve within a month or two.
Keep an eye on the Minnesota Court Search website, we might be seeing a new suit against the new registered agent any day now.
