Yes. They saw that DS1 was not strong enough, so they then requested a stronger material. KBLB never mentioned delivery of the samples. They mentioned the contract was cancelled prior to completion. No payments were received. Thus, the Army never got additional samples to test.

Spider silk is not like stealth technology. If this is fashioned into shoot packs and handed out to soldiers, someone will get their hands on a shoot pack and will be able to test the pack. Soldiers who survive shots will talk about their capabilities. Bored soldiers will shoot the pack on a fence, just for fun. You can't keep that kind of secret.

Furthermore, KBLB is selling their silks to other vendors. They can test the silk's performance characteristics.

Obviously if the Army had tested our silks but didn't want to release these results, they could have said "The tests were successful" without compromising any performance characteristics.

There is no indication that the Army ever tested DS2. The argument that the tests were secret, not just the results of the tests but the tests themselves, does not hold water.
