Because they have not been able to cover and they need this stock to stay down so the company goes under or enough people sell their shares to cover. The shorting happened before the reporting date so the loophole is they do not have to report it. They would only have to report short positions entered into after that date. Also keep in mind Amaritrade is still refusing to even file their new short positions. How many others that we have not heard about is doing the same?
