Yes, you are correct about this. Consent decree is about enforceable agreement between FHFA and FnF on scope and management of private FnF after release from conservatorship.

Below is my thinking but it is just thinking.

Probably the consent decree will provide some sort of enforceable protection rights to private investors to avoid indiscriminate use of conservatorship powers and 4617(f). Probably it will try to clarify FHFA's interpretation of HERA as envisioned by congress originally (or writers of HERA). This will try to correct the twisted and contorted rulings by the banana republic judiciary.

Hank, Obama administration and Judiciary totally messed up HERA with totally corrupt and twisted interpretation of HERA. One way is to modify HERA by Congress with correct interpretation but with unintended consequences. So probably Consent Decree is a safe administrative way of reinterpreting HERA so as to move forward with releasing FnF and then capitalizing them with investor protection rights.
