Identical case. Eagleview Technologies, a modest company, just recently won a huge court case against Xactimate, an industry giant. The subject of the case was that Xactimate took Eagleview’s technology and started producing and marketing the same product. I spoke to an Eagleview representative yesterday and he told me that what helped them win the case is that in today’s climate the juries are very sensitive and in favor of the little guy if there is even any chance that a big bad company took advantage the smaller guy.
