Based on your senerio the shorted shares will have to be settled/covered.
If there are actually a huge amount of shorted shares out there (very doubtful) then I say that Total will not make any deals until the issue is resolved. Instead of overpaying for shares based on an unrealistic sp from short covering, I would guess they would just walk away and let ERHC and their rights wither away and just buy the rights from the EEZ once ERHC loses them by default. Total plays the long game when it is in their favor.
Or Total could just let Offor and friends take ERHC private wait for Offor to eliminate the rights of those that thought they were actually shareholders. Then Offor could sell to Total to the benefit of only himself and friends.
I have no proof of the above but circumstantial evidence and common sense would leave most to assume it to be correct???? IMHO
