It will be interesting litigation. I agree with you that the claim for convertible prefs is extreme, and verging on extortive.It’s an unorthodox way of taking control of the IP as a remedy for misappropriation not as payment for the judgment debt. I don’t see Dimension prevailing but I can imagine a couple years of litigation. I doubt Dimension will simply accept that VDK 3 isn’t derived from VDK 2. If VDK 2 has not been modified, is it possible to simply hand over that source code to prove it, or is it technically complicated?
