The 5TH CIRCUIT should have invalidated the NWS- instead- they gave Treasury a scolding with the expectation that they would stop the NWS. The Judiciary needs to understand that they are a separate branch and must act independently. The fact that Treasury knew this decision was coming out and got ahead of the game by issuing a reform plan the day before the 5th ruling is disturbing. Give us our company back!! As per the Wallison article- it is simple- the administration could have placed the GSE into Receivership in. 2008- but they decide to place them in Conservatorship. Peter- you dont get your cake and eat it too! It’s either one or the other. The Admininstration took the easier route of Conservatorship- that is why we are at this crossroads.
You needed to take the sword in 2008- but you didn’t. Conserve- is to protect and preserve assets.
