I firmly now believe the sweep will not take place on September 30. En banc ruled it illegal. And today at the hearing Mnuchin basically said Treasury and FHFA are in talks to stop the sweep. His statement regarding appealing to the Supreme Court is all noise. He said it very quickly before the hearing in the noisy hallway with CNBC Diane Olick. If anything he might be considering appealing count 4. Count 1 is a done deal. Once official we double.
