I expect SCOTUS to grant cert if Treasury does appeal Count I. There is a split in the circuits, with everyone but the Fifth Circuit saying that the NWS was okay. A circuit split is a very common reason for SCOTUS to take a case.

Since the NWS is ending anyway by Mnuchin's own words, I think he just wants to make sure it ends on his and Calabria's terms, rather than having a court dictate it. Appealing to SCOTUS is a way to drag out the timeline and give FHFA and Treasury time to settle all the lawsuits.
